In your situation a few Cypress trees died in the backyard of your rental due to the extreme heat and lack of rain. We rented from MacLay for 6 months. Before we moved in were told the yard would be cleaned up and freshly maintained. It wasn't so I paid a landscaper $150 to clean up an overgrown backyard. The house was in decent shape but wasn't perfect. When we moved out we left it in the same condition it was in when we moved in except it was cleaner and the landscaping was perfect. Our Fiduciary duty is to the landlord... and not the tenant. So, it isn't a conflict of interest when we go to bat for the landlord! If a tenant leaves a house dirty or puts their hand-prints all over the walls -we will take care of the landlords property and have the house painted (and in this case the tenant gets to pay to cost).
