Spent 2 hours on phone and chat today before receiving a resolution. Representatives from FCU were unable to accurately explain the nature of a deposit (called it a check, it was a cash deposit) or the correct amount of the deposit. Despite not understanding anything about the deposit, the institution still levied fines on it.

Being as this deposit was placed into a non-First Community ATM, it was subjected to a hold until we received reconciliation from the depositing institution. Repossession is commonly the last resort to resolve an account when payments are not made according to the contract and we are unable to establish a workable arrangement to keep the account in good standing. The incompetence I am dealing with is astounding. I can't get ahold of the fraud management to deal with my case. My husband was trying to purchase a car so he called First Community to get an auto loan. He already had one through First Community but it was a total loss and we’re waiting for the insurance to pay off the vehicle. He had a recent loan open so they didn’t need to pull his credit but they informed him that he didn’t get approved for the total amount and a co-signer would help so I gave my information. The husband did call our Lending department on 5/3/2021 to apply for an auto loan. He was told that he could not be approved for the full amount and that his current auto loan would need to be paid off in full. I guess working for ******* *** for so many years, perhaps I was spoiled in a sense with being exposed to good customer service and working for a company that valued their customer and took the time to train their employees. We sent unauthorized ACH forms for the member to sign to be able to reimburse the member on 2/2/2021. The forms were signed by the member and the credit was processed on 2/8/2021. We have up to 10 business days to investigate and provide provisional credit. We do not place holds on US Treasury checks, unless people deposit them into an account not owned by the payee. We contacted the member to attempt to identify the check and payee and we were not able to make a determination.
First Community has sent a letter to it's members MANDATING "Arbitration of Claims & Disputes and Waiver of Class Action provision". The two most important reason this is unacceptable behavior is, 1st this mandate of policy is NOT legally enforceable. A person's legal rights to due process can not taken away. 2nd any company attempting to tell it's customers it does not have the right to due process often knows they are guilty of some malfeasance for which they are almost certainly going to be sued. After listening to his feedback on this matter, we explained our rationale for adopting an arbitration clause and class action waiver while also giving more context related to his concerns. We have added him to our opt-out list and gave him a direct line to someone at the Credit Union who is able to assist with any concerns he may have in the future.
