During a suspected DUI stop, the preliminary alcohol screening test (or PAS test) is meant to be voluntary (and you should be informed of this at the time). This is a portable breath test used at the scene to determine the presence of alcohol.

Popular television likes to imply that when a person “lawyers up” it is a sure sign of guilt. This is absolutely not the case. Invoking your rights as a citizen is just that – your right. It is not an admission of guilt.

Driving with a .08 BAC is not only enough to go to jail, but it also makes you 11 times more likely to be involved in a fatal car accident than someone without any alcohol in their system.

In the case of a DUI arrest, there is also a DMV case involved. At the time of the arrest, the officer takes away the license, which is sent to the DMV. Unless a hearing is requested within a certain time frame, the license will be automatically suspended.

Your blood alcohol content is defined by the amount of alcohol you have consumed over a certain period of time. It is not determined by the type of alcohol, but by the absorption rate. A typical adult will absorb one drink per hour and only time will bring the BAC down.
