If you have to get paid by this insurance company just expect to NEVER get paid your right amount, they don’t send payments on times, and your workers comp claim adjuster will do whatever they want and not reply to your lawyer. Your best options is to note everything with your lawyer and take them to comp court, THEY SUCK !!! Had Benchmark Workers' Compensation for two years. Both years, they "audit" after the end of the year and magically find you owe more money. Both times, they ignore information provided and claim you just owe them thousands more. This cannot be legal. It is fraud. I successfully proved to them they were wrong and they paid me a small refund. Not sure how an "audit" can say you owe $9,000 and then after you prove it, they pay your $300. Hmmm - something fishy in Benchmark.
