BAD FAITH. CSI contracted with a Third Party Seller (“TPS”) for the disposition of obsolete/excess construction materials and supplies. Acting on behalf of and at the direction of CSI, TPS came to terms for the sale of the materials with a Buyer. Buyer made payment for the materials and a mutually agreeable removal date was scheduled for the Buyer to pick up the materials.
