Michael’s document included same owner as granter and grantee and though it’s illegal, he doesn’t care and won't extinguish. Michael Carrico of Smidt, Reist & Keleher is not competent in real estate law. He drafted an illegal easement (without knowing the common law doctrine-of-merger) and burdened the innocent landowner for the last nine months with his mistake. He knows the document is illegal, but refuses to remedy. He has been reported to the NM Attorney Disciplinary Board for incompetence and unprofessionalism.
