Being served with a summons is not something to be taken lightly, no matter how unfounded the claims may be. There is strict protocol to follow, and failing to do so within the designated time limits can result in a judgment against you.

So what exactly does an education lawyer do? He or she is poised to help with legal issues that will ultimately hamper a student’s ability to get a quality education. This can involve everything from student rights and discrimination to how a school is governed.

When you’re bringing a lawsuit against someone, it’s important to know that your defendants don’t necessarily have to be people. They could be organizations, businesses or even government agencies.

While charter schools may seem like a separate entity, they are still a part of the public school system and must follow the laws mandated by the state. If your child is enrolled in a charter school, and you do not believe they are adhering to requirements, you may be able to take legal action.

The carrying and use of firearms has become a volatile issue. If you have been involved in something in which firearms played a role, you may be entitled to take civil action. We will need to know all the facts you have.

If you are seeking special services for your child at school, there are options if you are turned down. In addition to the Individuals with Disabilities Education Act, a second federal law, known as Section 504, could also help your child. This is a civil rights law that stops schools from discriminating on the basis of a disability.

In order for a class action lawsuit to be viable, those involved in the suit must be in substantially similar circumstances, where the common issues are critical to the lawsuit. This might involve, for instance, a large number of consumers who are injured as a result of an allegedly defective product.

Bullying and harassment, especially sexual harassment, are expected to be discouraged in schools and dealt with, and most districts now have policies in place regarding this. However, if you think your child has been victimized, and the school did not take proper action to protect him or her, you may have legal recourse.

What happens if you have no living relatives when you die? If you don’t have a will or haven’t updated your will, the rules of the state where you died will take precedence. In Maryland, for example, your assets would be sold and the money given to the state Board of Education. Instead, you could have a civil lawyer include a provision in your will naming your favorite charity in the event none of your relatives are alive when you pass away.
