Court of Appeals of Maryland just decided that Maryland's archaic, and punitive, contributory negligence doctrine for personal injury/accident cases is allowable. In a 5-2 decision, with two spirited dissents, the Court held that, while it has the power to outlaw the doctrine, that decision is better left to the legislature.
