(Ret) Judge Hilyer was a mediator AND arbitrator on a breach of contract dispute. 1. He should not have been both, a clear conflict of interest. Hilyer was the finder of facts and he failed to correctly understand most of the facts. 2. He failed to ensure one party complied with the agreement on time. 3. Entered a judgement when there were disputed material facts. He was angry there was an arbitration after his mediation went off the rails. Just finished a great mediation with Judge Laura Inveen (Ret.). I can't say enough great things about Judge Inveen. She was polite and courteous to my client. She was VERY effective and VERY professional. I intend to use Judge Inveen again as a mediator and highly recommend her!
