The federal bankruptcy law was overhauled significantly in 2005. The goal was get more bankruptcy filers into a Chapter 13 reorganization plan as opposed to Chapter 7 liquidation. The changes led to fewer bankruptcies for several years. However, that trend end by 2012, as total bankruptcies reached about 1.5 million for the year, with about 70 percent of individuals choosing Chapter 7.
Filing for bankruptcy may seem overwhelming, but then again, so is debt. Personal bankruptcy requires filing either Chapter 7 or Chapter 13, and a good lawyer can help you determine the proper steps to take to protect your assets and alleviate your debt.
